1. Acceptance of These Terms

These Terms & Conditions ("Terms") are a binding agreement between you and AirWorks Solutions, Inc. ("AirWorks Solutions, Inc.," "we," "us," or "our") and govern your access to and use of our website, online tools, and home-services offerings (collectively, the "Services"). By accessing our website, requesting an estimate, or engaging our Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services. You must be at least 18 years old and able to form a binding contract to use the Services.

2. About Us & Our Services

AirWorks Solutions, Inc. is a licensed home-services contractor (CA LIC# 950716) providing heating, air conditioning, indoor air quality, and plumbing services to homeowners in Camarillo and throughout Ventura County, California, and surrounding communities. Services are subject to availability, technician scheduling, and the condition of your property. We reserve the right to decline or discontinue service in our reasonable discretion, including where work cannot be performed safely or to code.

3. Estimates, Quotes & Pricing

We provide upfront, flat-rate pricing before authorized work begins. Estimates, quotes, online "instant" estimates, and any pricing shown on this website are informational and non-binding. They are based on the information available at the time, may exclude conditions not visible during assessment, and do not constitute an offer. A price becomes binding only when set out in a written or electronically signed agreement that you authorize. If additional work or materials are discovered, we will communicate the change and obtain your approval before proceeding.

4. Scheduling, Arrival & Cancellations

• Appointments are scheduled based on availability; arrival windows are estimates, not guarantees.
• Please provide at least 24 hours' notice to cancel or reschedule when possible.
• Missed appointments or refused access without notice may be subject to a service-call or trip fee.
• Emergency and after-hours service may be subject to additional rates, disclosed before work begins.
• You are responsible for providing safe, lawful access to the work area and disclosing known hazards.

5. Payment & Financing

Payment is due upon completion of services unless otherwise agreed in writing. We accept major credit cards, checks, and approved financing. Financing is provided by independent third-party lenders (including GoodLeap); approval, rates, and terms are determined solely by the lender and are subject to the lender's separate agreement and a credit decision. AirWorks Solutions, Inc. does not make credit decisions and is not the lender. Past-due balances may accrue interest and reasonable collection costs to the extent permitted by law.

6. Warranties & Guarantees

We stand behind our workmanship and offer the satisfaction and pricing guarantees described on our website, subject to their stated conditions. Equipment and parts carry the manufacturer's warranty, which is provided by the manufacturer and governed by its terms; we will pass through and help you administer applicable manufacturer warranties. Any workmanship warranty applies only to work performed by AirWorks Solutions, Inc., is non-transferable unless stated, and excludes damage from misuse, neglect, alterations by others, acts of nature, or pre-existing conditions. EXCEPT AS EXPRESSLY STATED, WE DISCLAIM ALL OTHER WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW. Nothing in these Terms limits any non-waivable rights you have under the California Contractors State License Law or other applicable law.

7. AI & Automated Tools

Our website may use artificial intelligence and automated tools to power chat, scheduling, instant estimates, and to help generate informational content. These outputs are generated automatically, may be incomplete or inaccurate, are illustrative only, and are not professional advice or a binding quote. Automated features operate with human oversight but without any guarantee of accuracy. Always rely on a licensed AirWorks Solutions, Inc. technician's on-site assessment for diagnosis, pricing, and recommendations.

8. No Professional Advice

Content on this website — including guides, the Learning Center, glossary, blog, and FAQ — is provided for general informational purposes only and does not constitute professional HVAC, plumbing, electrical, financial, or legal advice. Do not act on website content without consulting a qualified professional about your specific situation.

9. Intellectual Property & Limited License

The website and its content (text, graphics, logos, images, and software) are owned by or licensed to AirWorks Solutions, Inc. and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive license to view the website for personal, non-commercial use. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. This section concerns the website and online tools and does not limit any express service warranty in Section 6.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AirWorks Solutions, Inc. AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE WEBSITE OR AUTOMATED TOOLS. OUR TOTAL LIABILITY ARISING FROM YOUR USE OF THE WEBSITE OR ONLINE TOOLS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Liability for the physical services we perform is addressed in your service agreement and applicable law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless AirWorks Solutions, Inc. and its owners, employees, and agents from any claims, damages, liabilities, and reasonable attorneys' fees arising out of your misuse of the website, your violation of these Terms, or your violation of any law or third-party right.

16. Governing Law, Arbitration & Class-Action Waiver

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to the arbitration agreement below, the exclusive venue for any dispute is the state and federal courts located in Ventura County, California.

Binding arbitration. To the fullest extent permitted by law, you and AirWorks Solutions, Inc. agree that any dispute arising out of or relating to these Terms or the website/online tools will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court.

Class-action waiver. Disputes will be arbitrated only on an individual basis; you and AirWorks Solutions, Inc. waive any right to participate in a class, collective, or representative action.

30-day opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with your name and a statement that you opt out of arbitration. Opting out will not affect any other part of these Terms.

17. Dispute Notice & Informal Resolution

Before starting arbitration, please contact us so we can try to resolve the matter informally. Send a written notice describing the dispute and your requested resolution to the contact information below; we will have 30 days to respond before either party may pursue arbitration.

18. Changes; Severability; Entire Agreement

We may update these Terms from time to time; the "Last updated" date reflects the most recent version, and your continued use of the website after changes constitutes acceptance. If any provision is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy and SMS Terms, are the entire agreement regarding your use of the website; any service you purchase is also governed by your separate service agreement.
